1. Purpose

This Acceptable Use Policy ("AUP") governs your use of the HealthSquire platform, website, mobile application, and all related services (collectively, "the Platform"). This AUP supplements our Terms of Service and is incorporated by reference into those Terms.

By using the Platform, you agree to comply with this AUP. Violations may result in warnings, suspension, or permanent termination of your account at our sole discretion.

2. Lawful and Ethical Use

You agree to use the Platform only for lawful purposes and in accordance with all applicable federal, state, and local laws and regulations, including but not limited to:

  • HIPAA (Health Insurance Portability and Accountability Act)
  • State Nurse Practice Acts and professional licensing requirements
  • FLSA (Fair Labor Standards Act) and state labor laws
  • OSHA (Occupational Safety and Health Administration) regulations
  • Anti-discrimination laws (Title VII, ADA, ADEA, and state equivalents)
  • Anti-kickback statutes and healthcare fraud laws
  • State-specific healthcare staffing agency regulations

3. Prohibited Activities

3.1 Account and Identity Misuse

You may not:

  • Create accounts using false, misleading, or fraudulent identity information
  • Maintain multiple accounts to circumvent restrictions, bans, or fee obligations
  • Share account credentials with any third party or allow others to use your account
  • Impersonate another person, healthcare professional, or facility representative
  • Misrepresent professional credentials, licenses, certifications, or experience
  • Use another person's license number or professional credentials

3.2 Platform Circumvention

You may not:

  • Arrange shifts, payments, or staffing engagements outside the Platform to avoid fees after an initial introduction was made through HealthSquire
  • Solicit users to transact directly or through competing platforms for shifts or engagements originally facilitated by HealthSquire
  • Share or distribute internal Platform pricing, rate cards, or commission structures with third parties for competitive purposes
  • Encourage other users to violate this AUP or the Terms of Service

3.3 Data and Technology Misuse

You may not:

  • Scrape, crawl, or use automated tools to extract data from the Platform without express written authorization
  • Reverse-engineer, decompile, or disassemble any part of the Platform
  • Attempt to gain unauthorized access to accounts, systems, networks, or data
  • Introduce viruses, malware, trojans, or other malicious code
  • Interfere with or disrupt the Platform's servers, networks, or infrastructure
  • Use the Platform to send unsolicited messages, spam, or commercial solicitations
  • Circumvent any security, rate-limiting, or access-control measures
  • Use the Platform's API in ways that exceed your authorized access level or violate API rate limits

3.4 Content Violations

You may not post, upload, or transmit content that:

  • Contains false, misleading, or deceptive information about qualifications, availability, shift details, travel assignments, remote work, job applications, or continuing education
  • Is defamatory, libelous, harassing, threatening, or abusive toward any individual
  • Includes patient PHI, medical records, or identifiable health information unless specifically authorized and encrypted
  • Violates any person's intellectual property, trade secret, or proprietary rights
  • Contains discriminatory language based on race, color, religion, sex, national origin, age, disability, genetic information, veteran status, or sexual orientation
  • Promotes illegal activities or violates professional codes of conduct
  • Constitutes fraudulent or manipulated reviews, ratings, or endorsements

3.5 Professional Conduct Violations

You may not:

  • Practice outside the scope of your professional license or certification
  • Accept shifts for which you are not qualified or properly credentialed
  • Fail to disclose material changes to licensure status, disciplinary actions, or criminal history
  • Work while impaired by drugs, alcohol, or any substance that affects professional judgment
  • Abandon a shift or patient care assignment without proper notification and handoff
  • Retaliate against a user for filing a legitimate complaint, incident report, or safety concern

3.6 Facility-Specific Prohibitions

Facilities may not:

  • Post shifts with inaccurate descriptions, requirements, or compensation rates
  • Require professionals to perform duties outside their licensed scope of practice
  • Fail to provide a safe working environment that meets OSHA standards
  • Discriminate against professionals in shift assignments, evaluations, or pay
  • Misclassify employment relationships in violation of IRS or state guidelines
  • Withhold or delay payment in violation of agreed-upon terms

4. Reporting Violations

If you become aware of any violation of this AUP, you are encouraged to report it promptly. Reports can be made through:

HealthSquire prohibits retaliation against any user who makes a good-faith report of a suspected violation. All reports are investigated promptly and confidentially.

5. Enforcement and Consequences

Violations of this AUP may result in one or more of the following actions, at our sole discretion and depending on the severity and frequency of the violation:

  • Warning: Written notice of the violation and required corrective action
  • Temporary Suspension: Temporary restriction of access to some or all Platform features
  • Permanent Termination: Permanent removal from the Platform and forfeiture of pending payments where legally permitted
  • Legal Action: Referral to law enforcement, regulatory bodies, or initiation of civil proceedings as appropriate
  • Regulatory Reporting: Reporting to relevant licensing boards, state nursing boards, or healthcare regulatory agencies where required

For violations involving patient safety, fraud, or HIPAA breaches, we may take immediate action without prior warning.

6. Modifications

We may update this AUP from time to time to reflect changes in our practices, technology, legal requirements, or industry standards. Material changes will be communicated through the Platform or by email. Your continued use of the Platform after changes become effective constitutes acceptance of the updated AUP.
